(Dec 11): President-elect Donald Trump won a court order halting a lawsuit against him by the co-founders of his social media platform so a Delaware judge can weigh whether presidential immunity applies to the case.
Delaware Chancery Court Judge Morgan Zurn on Tuesday agreed to put the case on hold for at least three months. Zurn said she will consider Trump’s bid for immunity for himself and board members of Trump Media & Technology Group Corp, which oversees the Truth Social platform. The board members include Trump’s nominee to head the FBI, Kash Patel, and ex-Republican Congressman Devin Nunes. Trump is the company’s largest shareholder.
Zurn said in her order that because the case involves civil claims — rather than criminal charges — “Mr Trump is not presently deemed to be immune from this suit.”
Representatives of Trump, Patel and Nunes didn’t immediately respond to email requests for comment outside regular business hours.
Andy Litinsky and Wes Moss — former contestants on Trump’s onetime reality show The Apprentice who helped create Truth Social — sued in February, arguing the former president tried to stop them from getting a promised 8.6% stake in Trump Media when it went public. Trump countersued in Florida, arguing they didn’t deserve the shares.
The Delaware case is United Atlantic Ventures v Trump Media, 2024-0184, Delaware Chancery Court (Wilmington).
